Validity of the Sales Agreement, Product, and Price Information
- These terms and conditions apply when purchasing goods from the Online Store.
- The prices of products sold in the Online Store are indicated next to the products.
- The price includes the delivery fee, which depends on the delivery method. The delivery fee is displayed to the buyer when placing the order. Information about the goods is provided directly next to the goods in the Online Store.
Placing an Order
- To order goods, add the desired products to the shopping cart.
- To finalize the order, fill in the required fields and choose a suitable delivery method.
- The total cost will then be displayed, which can be paid using the payment solutions provided in the shopping cart. The agreement comes into effect from the moment the payable amount is credited to the Online Store's bank account.
- If the ordered goods cannot be delivered due to the goods being out of stock or any other reason, the buyer will be notified at the earliest opportunity, and the paid money (including delivery costs) will be refunded generally within 1-2 working days. Depending on the payment method, the refund may take up to 7 working days.
Delivery
- Goods are shipped to the following countries: Estonia. For international orders, please write to merli@ehepits.ee.
- The buyer bears the shipping costs, and the relevant price information is displayed next to the shipping method.
- Domestic shipments usually reach the destination specified by the buyer within 3-7 working days from the date the sales agreement takes effect. In exceptional cases, the goods may be delivered within up to 30 calendar days.
Right of Withdrawal
- After receiving the order, the buyer has the right to withdraw from the contract concluded in the Online Store within 14 days. To use the 14-day return right, the ordered goods must not be used in any other way than is necessary to ascertain the nature, characteristics, and functioning of the goods as allowed in a physical store.
- If the goods have been used for purposes other than necessary to ascertain their nature, characteristics, and functioning, or if they show signs of use or wear, the Online Store has the right to reduce the amount refunded according to the decrease in the value of the goods.
- To return the goods, the buyer must send a withdrawal letter to the e-mail address merli@ehepits.ee within 14 days of receiving the goods and agree on the return method. The buyer bears the cost of returning the goods unless the reason for the return is that the goods do not correspond to what was ordered (e.g., wrong or defective goods).
- The buyer must return the goods within 14 days after sending the withdrawal letter or provide proof that they have handed over the goods to the carrier within this period. Upon receipt of the returned goods, the Online Store will promptly, but no later than within 14 days, refund all payments received from the buyer under the contract. The Online Store may refuse to make a refund until the goods subject to the contract are returned or until the buyer provides proof of returning the goods, whichever occurs first.
- If the buyer has expressly chosen a delivery method different from the cheapest usual delivery method offered by the Online Store, the Online Store is not required to refund the cost exceeding the usual delivery method cost. The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the Online Store has been mistakenly indicated significantly below the market price of the goods.
Right to Submit a Complaint
- The Online Store is responsible for any non-conformity or defect of the goods sold to the buyer, which existed at the time of delivery and becomes apparent within two years from the date of delivery. During the first year, it is presumed that the defect existed at the time of delivery.
- The rebuttal of this presumption is the responsibility of the Online Store. The buyer has the right to notify the Online Store of any non-conformity within two months of discovering it by sending an e-mail to merli@ehepits.ee or calling 53066777.
- The Online Store is not responsible for defects that arise after the delivery of the goods due to the buyer's actions or inaction (e.g., improper use, accidents, etc.) or if they are due to normal wear and tear.
- If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods.
- If the goods cannot be repaired or replaced, the Online Store will refund all fees incurred under the sales contract to the buyer. The Online Store will respond to the consumer's complaint in writing or in a form that can be reproduced in writing within 15 days.
Direct Marketing and Processing of Personal Data
- The Online Store uses the personal data entered by the buyer (including name, phone number, address, email address, bank details) only for processing the order and delivering the goods to the buyer.
- The Online Store forwards personal data to the transport service provider for the purpose of delivering the goods.
- The Online Store sends newsletters and offers to the buyer's email address only if the buyer has expressed a wish to receive such notices by entering their email address on the website and indicating their desire to receive direct mail.
- The buyer can unsubscribe from offers and newsletters sent to their email at any time by notifying us via email or following the instructions provided in the email containing the offers.
Dispute Resolution
- If the buyer has any complaints regarding the Online Store, they should be sent via email to merli@ehepits.ee or by calling 53066777.
- If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can contact the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store.
- The review of the buyer's complaint by the commission is free of charge. The buyer can also turn to the European Union's dispute resolution platform.
